Notwithstanding the provisions of section five of this article, with respect to the construction industry classification of risks, the commissioner shall approve or issue premium ratesbased upon the number of hours worked for all construction workers.

NOTE: The purpose of this bill is to establish workers' compensation premium rates in the construction industry by the hours worked instead of a percentage of payroll.
