A BILL to amend article two, chapter twenty-three of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
five-c, relating to the computation of workers' compensation
rates in the construction industry.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section five-
c, to read as follows:
ARTICLE 2. EMPLOYERS AND EMPLOYEES SUBJECT TO CHAPTER;
EXTRATERRITORIAL COVERAGE.
§23-2-5c. Computation of premium rates in the construction
industry.
Notwithstanding the provisions of section five of this
article, with respect to the construction industry classification
of risks, the commissioner shall approve or issue premium ratesbased upon the number of hours worked for all construction
workers.
NOTE: The purpose of this bill is to establish workers'
compensation premium rates in the construction industry by the
hours worked instead of a percentage of payroll.
